History is indeed made up of significant events which shape our future and outstanding leaders who influence our destiny. It’s through their good leadership that domestic tranquility and the rule of law is assured. I believe that before getting to any destination you need to know where your journey commenced or to know where you are coming from. As Kenyans we are coming from the Nyayo Era or “Nyayoism” an era that deprived Kenya of its great pride, an era that was filled with autocracy, corruption and the abuse of the rule of law. “Nyayoism” is gone and its time we got back the Kenyan pride that had been there a decade or two ago. This can only happen by having a government that’s for the people and that’s voted in by the people. A government governed by a fair constitution a thing some of our leaders are failing to understand. There are two questions, our leaders have not asked themselves and if they have, they are yet to come up with a concrete answer. These are “What is a constitution?” and “Why have a constitution?” The constitution of a society contains the fundamental principles, which govern its operation. The process of writing a constitution will serve to clarify our purpose, delineate our basic structure and provide the cornerstone for building an effective society. It will also allow members to have a better understanding of what the society is all about and how it functions. The reason the Ten Commandments were given to Moses by God, are the same reason a society needs to have a constitution. This is not to say that our leaders do not know this but they seem to ignore the fundamental factors that will lead to good governance. They are failing from a number of fronts, such as by delaying the review process, by attacking each other’s credibility and the most crippling are the few who want the new constitution to suite their own interest. The goal should be to come up with a constitution that will be fair and balanced, a constitution that will represent every Kenyan today and the future. For this to be achieved, our leaders need to be at par with each other, put aside their personal interest and differences and work to fulfill the interest of the nation. A properly working government is more adaptable to the preferences of the people, more open to experiment and its rational evaluation, more resistant to shock and misadventure, more politically efficient and more stable. Its decentralized, participatory structure is a buttress of liberty, a counterweight to elitism, and a seedbed of ‘social capital’. Lets not forget it was German that executed Nazism, by writing one of the worlds most democratic constitution and they have lived up to it till today. It is our turn to crucify “Nyayoism”, by writing a constitution that will transform Kenya, a constitution that will drive us away from the destructive force that had been mounted in our backs for years to a constructive path of a free and fair society.
